Health Code Violations Spark Legal Battle at Thunder Bay Senior Building

Published on

The Thunder Bay District Health Unit (TBDHU) is resorting to legal action against the owner of a seniors’ apartment building for failing to rectify numerous health code violations. Abby Mackie, a public health inspector at TBDHU, mentioned that compliance orders were issued to SMS Property Trust Inc. on July 8 and July 29 following complaints regarding high temperatures, overflowing trash, and bedbug infestations at Vickers Manor.

Mackie explained that issuing orders is a last resort, with a preference for education and cooperation to address health hazards. Vickers Manor, previously known as McKellar Place, provides independent living units for seniors and assisted living units managed by Brain Injury Services of Northern Ontario.

Apart from health code breaches, the owner is also facing multiple fire code violations. Unpaid bills earlier in the summer almost led to utility disconnections, prompting volunteers to start a crowdfunding campaign to provide meals for residents.

SMS Property Trust Inc., owned by Ongrasothy Masillamany of Markham, is facing 36 offenses under the Health Protection and Promotion Act related to excessive heat. Masillamany is summoned to appear in court in response to the issued orders. A ruling and potential fine will be determined by a justice of the peace if found guilty, with a court appearance scheduled for November 25 via video conference.

The City of Thunder Bay’s Municipal Emergency Control Group is closely monitoring the situation at Vickers Manor to prevent service disruptions endangering tenants. Efforts are underway to connect residents with available services and alternative housing options within the community.

Lise Vaugeois, NDP MPP of Thunder Bay—Superior North, has criticized the conditions at Vickers Manor as unacceptable and has urged the Rental Housing Enforcement Unit to investigate compliance with the Residential Tenancies Act. Vaugeois emphasized the importance of ensuring residents are not displaced without proper housing arrangements.

Sharon Zoschke, a resident at Vickers Manor, expressed a strong attachment to the community despite challenges faced by tenants, including fears of eviction. Zoschke highlighted the importance of keeping residents informed about changes and potential developments at the building. She emphasized the significance of faith and community support during difficult times.

The ongoing situation at Vickers Manor has raised concerns among local officials and residents, with efforts being made to address the issues and support the well-being of all tenants.
