Juno Award-winning artist Ashley MacIsaac has decided to drop his legal action against Google regarding an AI-generated summary that falsely labeled him as a sex offender. Earlier this year, the 51-year-old musician filed a lawsuit in the Ontario Superior Court of Justice after discovering the AI overview on Google’s search page wrongly claiming he had been convicted of various offenses, including sexual assault and attempting to assault a minor, and was listed on the national sex offender registry, all of which were untrue.
Originally seeking $1.5 million in damages from Google LLC, MacIsaac’s lawsuit highlighted the serious nature of the false allegations and emphasized that Google should not evade liability just because the defamatory statements were disseminated by Google’s software. Despite not providing a reason for discontinuing the lawsuit, MacIsaac declined to comment on the matter when approached by the National Post, with CBC News also seeking his input.
Google did not respond to CBC News’ inquiry about the lawsuit’s discontinuation. In a previous statement, Google Canada mentioned that their AI summaries are periodically updated to offer the most useful information and any errors are utilized to enhance the system.
The introduction of AI overviews by Google in 2024 has triggered controversies and legal battles, with several companies and publishers alleging reduced website traffic due to the feature. Concerns have also been raised about the potential for AI to generate false information, leading to misinformation.
The misinformation surrounding MacIsaac led to the cancellation of one of his concerts, causing him considerable distress during subsequent performances. Despite facing financial constraints in pursuing legal action against Google, MacIsaac was approached by multiple law firms offering pro bono assistance.
Legal expert Justin Safayeni explained that discontinuing a lawsuit before trial can be due to various reasons, such as financial limitations, the perceived unwinnability of the case, or private settlement negotiations. Discontinuing a lawsuit differs from dismissal as it can potentially be revived later, barring any settlement terms preventing it.
The issue of accountability for damages caused by AI-generated false information has been a contentious topic for tech companies like Google, with a recent Munich court ruling holding Google liable for misinformation presented in its AI summaries. This decision marked a significant development in determining responsibility for AI-generated content. Google has expressed intent to challenge the ruling.
Air Canada also faced a legal battle over its AI chatbot’s actions, with the airline ultimately being held accountable and required to provide compensation for the misinformation provided by the chatbot to a customer. The unresolved question of liability in AI-induced defamation cases in Canadian courts is expected to be addressed in the future, given the increasing use of AI tools in various sectors.
Despite efforts by companies like OpenAI to address the issue of AI models generating false information, challenges persist in curbing such occurrences, as the models primarily focus on statistical probabilities rather than discerning truth from falsehood.
