“CMA Investigates Companies Over Online Pricing Tactics”

An investigation has been initiated into eight companies due to concerns regarding their online pricing tactics, with an additional 100 businesses expected to receive warnings.

The companies under scrutiny include StubHub, Viagogo, AA Driving School, BSM Driving School, Gold’s Gym, Wayfair, Appliances Direct, and Marks Electrical.

The Competition and Markets Authority (CMA) is conducting inquiries into how fees are displayed online, potential misrepresentation of time-limited offers, and the automatic enrollment of customers in optional charges.

Specifically, StubHub and Viagogo, secondary ticket selling platforms, are being investigated for additional charges applied during ticket purchases.

AA Driving School and BSM Driving School are facing scrutiny for their fee presentation practices on their websites, including the timing of fee disclosures during the purchase process.

Gold’s Gym is under investigation for how it presents a one-off joining fee for its annual membership, particularly regarding its introduction midway through the sign-up process.

Wayfair is being examined for time-limited sales, Marks Electrical for default opt-ins, and Appliances Direct for their utilization of time-limited sales and default opt-ins.

The CMA has indicated that these companies are being investigated due to suspected violations of consumer law, although no final decisions have been reached yet.

These cases mark the first applications of the CMA’s new consumer protection authority. The CMA is also sending letters to 100 other businesses to address concerns regarding additional fees and sales strategies.

Sarah Cardell, the chief executive of the CMA, emphasized the importance of ensuring that consumers can shop online confidently, with transparent pricing and genuine sales, especially during times of financial strain.

Cardell further stated that businesses must comply with consumer protection laws, and the CMA will take swift action against any illegal practices that harm consumer interests.

A spokesperson from AA Driving School affirmed that their fee structure aligns with CMA regulations and that they are willing to enhance transparency for customers during the booking process.

Viagogo also expressed cooperation with the CMA investigation, highlighting their ongoing engagement with the authority.

The Mirror has reached out to Gold’s Gym, Wayfair, Marks Electrical, and Appliances Direct for comments. It is notable that BSM Driving School is a subsidiary of AA, while Viagogo and StubHub share the same parent company.
