Prime Minister Mark Carney’s administration left the role of Canada’s prison watchdog unfilled for an extended period, despite warnings from the outgoing correctional investigator that this negligence would severely impact the office’s ability to safeguard inmates. Documents obtained through Canada’s Access to Information Act show that former correctional investigator Ivan Zinger cautioned Public Safety Minister Gary Anandasangaree about the serious legal repercussions of not appointing a successor before his departure.

Following approximately four months of vacancy, an interim investigator was appointed, a decision that has raised concerns due to the temporary nature of the role. The Office of the Correctional Investigator (OCI) serves as an independent overseer for prisoners nationwide, handling an average of 4,000-5,000 complaints annually. Over the years, the OCI’s efforts have led to significant investigations, such as the inquiry into Kingston’s Prison for Women in the mid-1990s, which exposed violations of inmates’ rights and the harsh treatment of women.

During his tenure, Zinger identified various issues in Canadian prisons, including inadequate access to mental health care and the disproportionate representation of Indigenous inmates. Despite giving a seven-month notice to the government before his early departure, Zinger expressed growing frustration as no steps were taken to find his replacement.

In a letter to Anandasangaree, Zinger highlighted the critical need to fill the position promptly to ensure the office’s functionality and compliance with its legislative mandate. He emphasized the importance of having a correctional investigator in place to conduct investigations, issue reports, and address confidential information related to inmate safety and well-being.

Zinger’s correspondence sheds light on broader challenges with delays in government appointments, impacting various organizations. Anandasangaree’s office has yet to announce a permanent replacement, stating that the process is underway without specifying a timeline or whether an open competition will be held.

Acting as the interim correctional investigator, Valerie Phillips acknowledged facing challenges in her role, particularly in dealing with Correctional Service Canada’s headquarters and obtaining approvals for reports. While Phillips now holds investigative powers, she acknowledged the limitations of an interim position in implementing long-term strategies or organizational changes.

Zinger expressed concerns about the prolonged vacancy and the absence of a competitive process to find a permanent replacement, stressing the importance of independent oversight in the correctional system. Advocates like Sen. Kim Pate and Emilie Coyle emphasized the critical need for a correctional investigator to ensure accountability and protect the rights of incarcerated individuals. Opposition voices, including NDP public safety critic Jenny Kwan, criticized the government’s inaction and lack of clarity on the appointment process, citing the urgency in addressing systemic issues within Canada’s prisons.
